Exemptions include foundational models, and developers are encouraged to adopt common documentation practices like model maps and datasheets to facilitate information exchange in the AI value chain.

The EU AI Act Draft highlights the significance of software and data, released under a free and open-source license, contributing to research and innovation, fostering market growth, and offering opportunities for the Union economy.

The act encourages the use of licenses that allow open sharing, free access, modification, and redistribution of AI-related models, promoting the development of trustworthy AI systems in the European Union.

Despite efforts, France has not yet built a blocking minority. The situation will become clearer when member states provide feedback at the technical level.

If concessions are not secured, France plans to maintain pressure to influence the AI law's implementation, particularly concerning secondary legislation, as the file remains a top national priority.
